Terms and Conditions

§ 1 GENERAL PROVISIONS

  1. The website tomorrowland.pl operates in accordance with the rules set out in these Terms and Conditions.
  2. These Terms and Conditions define the terms for concluding and terminating product sales agreements and the complaint procedure, as well as the types and scope of services provided electronically via the website tomorrowland.pl, the rules for their provision, and the conditions for concluding and terminating contracts for the provision of electronic services.
  3. Each customer, by taking steps to use the electronic services of tomorrowland.pl, agrees to comply with the provisions of these Terms and Conditions.
  4. For matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply, in particular:
  • The Civil Code of April 23, 1964
  • The Consumer Rights Act of May 30, 2014
  • The Act on Out-of-Court Resolution of Consumer Disputes of September 23, 2016
  • The Act on the Provision of Electronic Services of July 18, 2002

§ 2 DEFINITIONS

  • Order Form – a form available on the tomorrowland.pl website allowing order placement.
  • Client – a person intending to or having concluded a sales agreement with the Seller.
  • Consumer – a natural person making a legal transaction with an entrepreneur not directly related to their business or professional activity.
  • Entrepreneur – a natural or legal person, or an organizational unit with legal capacity, conducting business or professional activity in their own name.
  • Product – a movable item available in the Store, which is the subject of a sales agreement between the Client and the Seller.
  • Terms and Conditions – this document defining the rules of the online store.
  • Store – the online service operating at tomorrowland.pl.

  • Sales Agreement – an agreement concluded between the Client and the Seller via the Store.
  • Order – a declaration of intent by the Client to conclude a sales agreement.
  • Price – the value of the product expressed in Polish zloty (PLN), including all price components.

§ 3 PRODUCT INFORMATION AND ORDERING

  1. The online store tomorrowland.pl sells products via the Internet.
  2. Information on the Store’s website does not constitute an offer within the meaning of civil law. Placing an order by the Client is a purchase offer under the conditions specified in the product description.
  3. Product prices are given in Polish zloty (PLN) and include all price components.
  4. Orders can be placed via the website tomorrowland.pl/cennik, 24 hours a day, all year round.
  5. Placing an order requires reading and accepting the Terms and Conditions.

§ 4 CONCLUSION OF THE SALES AGREEMENT

  1. To conclude a sales agreement, the Client places an order in accordance with § 3 points 5 and 6.
  2. After placing the order, the Seller immediately confirms its receipt electronically.
  3. The confirmation binds the Client to their offer and includes:
  • all essential elements of the order,
  • the Terms and Conditions and information on the right of withdrawal.
  1. Upon receipt of confirmation by the Client, the sales agreement is concluded.
  2. A proof of purchase is included with the product shipment.

§ 5 PAYMENT METHODS

  1. The Seller provides the following payment methods:
  • electronic payments (credit card, quick transfer from selected Polish banks).
  1. Payment must be made before the order is processed.

§ 6 RIGHT OF WITHDRAWAL

  1. The Consumer has the right to withdraw from the agreement without giving any reason within 14 days.
  2. In the event of withdrawal, the Client must return the product within 14 days.
  3. The right of withdrawal applies to both parties if the other party fails to fulfill its obligations.

§ 7 TYPES AND SCOPE OF ELECTRONIC SERVICES

  1. The Store enables the conclusion of sales agreements in electronic form.
  2. Services are provided under the terms set out in the Terms and Conditions.
  3. The Seller may place advertising content on the Store’s website.

§ 8 CONDITIONS FOR THE PROVISION OF ELECTRONIC SERVICES

  1. Electronic services related to placing orders are provided free of charge.
  2. The contract for the provision of electronic services is concluded for a definite period and ends upon completion of the order process.
  3. Technical requirements:
  • a web browser with JavaScript and Cookies enabled,
  • a computer or mobile device with Internet access,
  • an active email account.
  1. The Client is obliged to use the Store in accordance with the law and good practice.

§ 9 COMPLAINTS

  1. Complaints should be sent to the email address: info@tomorrowland.com.
  2. The complaint should include as much detail as possible regarding the irregularities.
  3. Complaints are reviewed within 14 days.

§ 10 FINAL PROVISIONS

  1. Agreements are concluded in accordance with Polish law.
  2. In case of inconsistency between the Terms and Conditions and the law, the relevant provisions of Polish law shall apply.
  3. Disputes between the Client and the Seller shall be resolved amicably in the first instance.
  4. If no agreement is reached, disputes will be resolved by a competent common court.
